These Terms of Service ("Terms") govern your use of the Swyft Letter mobile application ("the App") operated by Swyft Letter ("we", "our", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms in full.

1. Service Description

Swyft Letter is an AI-powered cover letter generation service. The App uses artificial intelligence (x.ai Grok) to create personalised cover letters based on information you provide, including your resume, job details, writing style preferences, and personal profile.

2. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account and Device

The App identifies your device using a hashed device fingerprint. This is used to enforce usage limits and prevent abuse of the free tier. You are responsible for:

• Maintaining the security of your device
• All activity that occurs on or through your device in connection with the App
• Ensuring the accuracy of information you provide

4. Acceptance of Terms

You must accept these Terms and our Privacy Policy before using the App. Your acceptance is recorded with your device information, timestamp, and IP address for audit and compliance purposes. Continued use of the App constitutes ongoing acceptance of the most current version of these Terms.

Pricing, subscriptions, and payment terms

5. Free Tier

Each device is entitled to one (1) free basic cover letter generation for the lifetime of the device. The free generation produces a shorter, structured cover letter (approximately 150-200 words). This entitlement is non-transferable and is tied to the device, not to the user.

6. Paid Services

After using the free generation, the following paid options are available:

• Pay Per Letter: Individual premium cover letters may be purchased for EUR 6.99 each. Premium letters are longer, more detailed, and fully tailored (3-4 paragraphs).
• Standard Subscription: EUR 9.99/month for up to 10 premium cover letter generations per billing period.
• Professional Subscription: EUR 15.99/month for up to 30 premium cover letter generations per billing period.

All prices are inclusive of applicable taxes where required by law. Prices are quoted in Euros (EUR) and may vary by region based on app store pricing tiers.

7. Payment Processing

All purchases are processed through Apple's App Store or Google Play Store via our payment partner RevenueCat. We do not directly process, store, or have access to your payment card details. Payment terms, including billing cycles and payment methods, are governed by the respective app store's terms of service.

8. Subscription Terms

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Unused cover letter generations do not carry over to the next billing period.
• You can manage and cancel your subscription through your device's app store settings (Apple App Store or Google Play Store).
• Cancellation takes effect at the end of the current billing period. You will retain access to your subscription benefits until that date.

9. Refund Policy

Since cover letter generation involves immediate consumption of AI processing resources, refunds are handled as follows:

• Pay-per-letter purchases: Refund requests for individual letters should be directed to the respective app store (Apple or Google) within their refund window, typically 14 days of purchase.
• Subscriptions: Subscription refunds are managed by Apple App Store or Google Play Store in accordance with their respective refund policies.
• Service failures: If a cover letter generation fails due to a technical error on our end and you do not receive a usable cover letter, your generation credit will be restored automatically. If it is not restored, please contact us at hello@swyftletter.com.

10. Cancellation

You may stop using the App at any time. To cancel a subscription, you must do so through your device's app store settings. Deleting the App does not automatically cancel your subscription. We are not responsible for charges incurred if you fail to cancel through the app store.

11. Permitted Use

You agree to use the App only for its intended purpose: generating professional cover letters for legitimate job applications and professional correspondence.

12. Prohibited Conduct

You must not:

• Attempt to manipulate the AI to generate content other than cover letters (e.g., code, stories, essays, emails unrelated to job applications)
• Submit prompt injection attacks or attempt to bypass content moderation safeguards
• Use the service to generate offensive, discriminatory, defamatory, or illegal content
• Circumvent device-based usage limits through technical manipulation, device spoofing, or other means
• Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App
• Use automated tools, bots, or scripts to interact with the App
• Resell, sublicense, or commercially redistribute cover letters generated by the App
• Misrepresent AI-generated content as being entirely your own original work in contexts where disclosure is legally required
• Use the App for any purpose that violates applicable local, national, or international law

13. Content Moderation

We implement strict server-side content moderation to enforce acceptable use. This includes keyword filtering, input validation, prompt injection detection, and AI-level guardrails. Requests that violate our acceptable use policy are automatically rejected. We reserve the right to block or restrict devices that repeatedly violate these terms.

Disclaimers about AI-produced cover letters

14. Nature of AI Content

Cover letters generated by the App are created using artificial intelligence (x.ai Grok). AI-generated content is produced algorithmically and may not always be perfect. You acknowledge and agree that:

• AI-generated cover letters are a starting point and should be reviewed and edited by you before use
• The AI may occasionally produce inaccurate, incomplete, or contextually inappropriate content
• The quality of output depends on the quality and completeness of input you provide
• We do not verify the factual accuracy of information included in generated cover letters

15. No Employment Guarantee

Swyft Letter is a productivity tool. We make no representations, warranties, or guarantees that:

• Any cover letter will result in a job interview or employment offer
• Generated content will be suitable for any particular job application, employer, or industry
• The App will meet your specific requirements or expectations

You are solely responsible for reviewing, editing, customising, and using any content generated by the App. We strongly recommend proofreading all cover letters before submitting them to potential employers.

Ownership and licensing

16. Your Content

You retain full ownership of all content you input into the App, including your resume, job descriptions, profile information, and personal details. By using the App, you grant us a limited, non-exclusive licence to process this content solely for the purpose of generating your cover letter.

17. Generated Content

You own the cover letters generated for you through the App and may use them freely for job applications and professional purposes. This ownership is subject to any rights retained by the underlying AI model provider (x.ai).

18. Our Intellectual Property

The App's design, user interface, branding (including the Swyft Letter name and logo), underlying technology, prompts, algorithms, and all associated intellectual property remain our exclusive property. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our express written permission.

⚖ Limitation of Liability

19. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Swyft Letter and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to:

• Loss of employment opportunities or income
• Inaccuracies, errors, or omissions in AI-generated content
• Service interruptions, downtime, or unavailability
• Data loss on your device or our servers
• Unauthorised access to or alteration of your data
• Any third-party conduct or content

Our total aggregate liability for any and all claims arising from or related to your use of the App shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the claim, or (b) EUR 50.00.

21. Indemnification

You agree to indemnify, defend, and hold harmless Swyft Letter from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

22. Force Majeure

We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, or disruptions to third-party AI services.

Availability and modifications

23. Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We will make reasonable efforts to notify users of significant changes that affect paid services.

24. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you through the App and request your acceptance of the updated Terms
• Provide a summary of material changes where practicable

Your continued use of the App after notification constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the App and cancel any active subscriptions.

25. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination:

• Your right to use the App ceases immediately
• Any unused subscription credits are forfeited
• Provisions that by their nature should survive termination shall survive (including limitation of liability, indemnification, and governing law)

🌎 Governing Law

Legal jurisdiction and dispute resolution

26. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland and the European Union. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

This choice of jurisdiction does not affect your rights as a consumer under the mandatory consumer protection laws of your country of residence within the European Union.

27. Dispute Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at hello@swyftletter.com to attempt to resolve any dispute informally. We will make good faith efforts to resolve your concern within 30 days.

EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

29. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Swyft Letter regarding the use of the App and supersede all prior agreements, understandings, and communications.
